Terms of Service -- Sacramento for Democracy

By using the Sacramento for Democracy Website (the “Website”) you agree to be bound by the Terms forth below (“Terms” or this “Agreement”).

This Agreement includes Sacramento for Democracy's acceptable use policy for content posted on the Website, and we consider these Terms binding on your use of the Website.

1. Users agree to abide by all of the terms and conditions of this Agreement.

2. Sacramento for Democracy is an independent website not affiliated with or endorsed by Democracy for America.

3. Responsibility for Postings. By posting any material anywhere on the Sacramento for Democracy Website, you expressly agree that any material or information (“Content”), without limitation, that you post, place, display, distribute, or otherwise make available (“postings”) on the Sacramento for Democracy Website is solely your responsibility. Thus, you and only you are responsible for that content, and Sacramento for Democracy is not responsible for that content.

4. Inappropriate Content. Sacramento for Democracy has a deep and conscious respect for the First Amendment and freedom of speech. However, Sacramento for Democracy will not tolerate inappropriate content of any type whatsoever on its website. By posting any material on the Sacramento for Democracy Website, you expressly agree that any and all Content, without limitation, will comply with any and all Sacramento for Democracy policies pertaining to the appropriateness of Content, including but not limited to, those policies that appear below.

You understand and agree that Sacramento for Democracy may review and delete any Content that, in the sole discretion of Sacramento for Democracy violates or is inconsistent with this Agreement or that might be illegal, offensive or inappropriate or that might interfere with the rights of Sacramento for Democracy or its supporters, or that might harm or threaten Sacramento for Democracy or its supporters.

The following is a partial list of the kind of Content that is not permitted on the Website:

Content that is illegal or otherwise promotes or supports illegal activity, under any federal, state or local law;

Content that solicits any contribution to Democracy for America or Sacramento for Democracy that is not legal under federal election law, including, but not limited to, the solicitation of contributions from foreign nationals, federal contractors, minors, corporations, or labor unions, or from persons in the name of another, or in excess of the amounts that may legally be contributed;

Content that promotes or supports any other activity that is not permitted under federal election law;

Content that promotes or supports hatred, discrimination, racism or bigotry hatred toward any person or group of persons;

Content that harasses or advocates the harassment of another person;

Content that displays pornographic or sexually explicit material of any kind;

Content that contains profanity or other obscene, abusive, or inappropriate language;

Content that is threatening to any person or persons, whether it be a threat of physical, emotional or other perceived harm;

Content that contains information that you know is untrue or Content that libels or defames any person or group of persons;

Content that contains the unauthorized use or theft of another person’s copyrighted work, or any other Content that borrows such work without obtaining the appropriate permissions in advance;

Content that exploits anyone under the age of 18;

Content that instructs or encourages any person to violate any law or otherwise engage in illegal activity;

Content that promotes, supports, directs, requests, or otherwise encourages any non-political activity, including, but not limited to commercial, business, personal or other non-profit activities;

Content that promotes, supports, directs, requests, or otherwise encourages in any scheme that, while possibly not illegal, may not be appropriate for or approved by Sacramento for Democracy, including, but not limited to, raffles, sweepstakes, contests, trades, or barters;

Content that links to other Websites that contain Content not in compliance with these policies;

Content that is in anyway password-protected, restricted or not other wise in plain view, unless such format has been specifically approved in advance in writing by Sacramento for Democracy;

Any other Content that is patently offensive to the online community;

Any other Content that, in the sole discretion of Sacramento for Democracy, is inconsistent with the purposes of Sacramento for Democracy or otherwise violates commonly held principles of appropriate conduct, behavior or language.

5. License. By posting Content to any area of the Website, you automatically grant, and you represent and warrant that you have the right to grant, to Sacramento for Democracy an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute such Content and to prepare derivative works of, or incorporate into other works, such Content, and to grant and authorize sublicenses of the foregoing.

6. Copyright Policy. You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights.

7. Termination. Sacramento for Democracy reserves the right, in its sole discretion, to investigate and take appropriate legal action against anyone who violates this provision, including without limitation, removing the offending communication from the Website and terminating the usage of such violators.

8. Term. This Agreement will remain in full force and effect while you use the Website. Sacramento for Democracy reserves the right to your usage for any reason, at any time.

9. Privacy. Use of the Website is also governed by our Privacy Policy.

10. Proprietary Rights on Sacramento for Democracy. Sacramento for Democracy owns and retains all proprietary rights in the Website. The Website contains the copyrighted material, trademarks, and other proprietary information of Sacramento for Democracy, and its licensors.

11. Disclaimers. Sacramento for Democracy is not responsible for any incorrect or inaccurate Content posted on the Website, whether caused by users of the Website or by any of the equipment or programming associated with or utilized by the Website. Sacramento for Democracy is not responsible for the conduct, whether online or offline, of any user of the Website. Sacramento for Democracy assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user communications. Sacramento for Democracy is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email on account of technical or traffic congestion on the Internet or at any Website or combination thereof, including injury or damage to users or to any other person’s computer related to or resulting from participating or downloading materials in connection with the Website. Under no circumstances will Sacramento for Democracy be responsible for any loss or damages resulting from anyone’s use of the Website, any Content posted on the Website or transmitted via the Website, or any interactions between users of the Website, whether online or offline.

12. Limitations on Liability. Even though Sacramento for Democracy prohibits inappropriate Content, we do not control every posting, resulting in a small chance that you might see items that we deem to be inappropriate. You expressly agree to waive your right to any damages from Sacramento for Democracy related to such exposure, and, in no event, will Sacramento for Democracy be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, arising from your use of the Website.

13. Disputes. If there is any dispute about or involving your use of the Website, you agree that the dispute will governed by the laws of the State of California, without regard to its conflict of law provisions.

14. Fair Use Notice. This site may contain copyrighted material the use of which has not always been specifically authorized by the copyright owner. We are making such material available in our efforts to advance understanding of political, human rights, economic, democracy, and social justice issues, etc. We believe this constitutes a 'fair use' of any such copyrighted material as provided for in section 107 of the US Copyright Law. In accordance with Title 17 U.S.C. Section 107, the material on this site is distributed without profit to those who have expressed a prior interest in receiving the included information for research and educational purposes. If you wish to use copyrighted material from this site for purposes of your own that go beyond 'fair use', you must obtain permission from the copyright owner.

15. Other. Any and all of these Terms may be modified by Sacramento for Democracy at any time and without prior notice, such modifications to be effective upon posting by Sacramento for Democracy on the Website. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. The section titles in these Terms are for convenience only and have no legal or contractual effect.
